GUEST RENTAL AGREEMENT
This Guest Rental Agreement (“Agreement”) is entered into between Elite Lake Rentals LLC (“Elite,” “Company,” “we,” or “us”), acting for itself and for the owner of the Property (“Owner”), and the person who is the responsible renter of the Property (collectively “Renter” or “you”).
By booking your rental of the Property with Elite, you acknowledge that you have read and understand, and agree to be bound by, all terms, conditions, and policies in this Agreement, including any Property-Specific Terms (collectively, the “Terms”).
ARTICLE I: PROPERTY USE AND OCCUPANCY
Section 1.1 Maximum Occupancy
The Property shall not be used at any time by more than the number of adults and children listed in your confirmed reservation. All occupants must be registered guests. Exceeding maximum occupancy at any time, including with day visitors, is prohibited and may result in immediate termination of the rental agreement without refund.

Section 1.2 Minimum Age Requirements
The “Minimum Age” to rent the Property is twenty-five (25) years of age, or the age specified in any Property-Specific Terms. The primary Renter who makes the reservation must be at least 25 years of age and must be present at the Property for the entire duration of the rental.

Section 1.3 Responsible Renter
As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over the Minimum Age, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.
Section 1.4 No Permanent Residence
You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.
Section 1.5 Unregistered Guests and Visitor Policies
Only registered guests may stay overnight at the Property. Unauthorized visitors or gatherings are strictly prohibited.

ARTICLE II: CONDUCT AND BEHAVIOR POLICIES
Section 2.1 Good Neighbor Policy
Because the Property is a privately owned home, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to Elite from police, neighbors, or neighborhood or homeowner associations.
Quiet Hours and Noise Policy: Noise audible outside the Property is prohibited between 10:00 p.m. and 8:00 a.m. You and other Occupants agree to abide by all applicable parking restrictions and limitations.
Noise Monitoring: Elite properties are proactively monitored for compliance with this noise policy. Decibel sensors notify Elite of sounds in the property that exceed 75 decibels (dB). The noise sensors are 100% privacy compliant and required on this property. You hereby consent to the use of sound level monitoring. If Elite receives a noise complaint from a neighbor and/or receives a notification that the noise level in the property has exceeded 75dB, Elite will contact you and issue a first warning to reduce the noise level. If, after the first warning, Elite subsequently receives an additional noise complaint and/or notification that the noise level in the property has exceeded 75dB, Elite reserves the right, in its sole discretion, to charge you a penalty of $500 and/or remove you and all occupants from the property without a refund.
Section 2.2 Prohibited Activities
The following activities are strictly prohibited:
ARTICLE III: ANIMALS AND PETS
Section 3.1 Pet Policy
No animals or pets of any kind are permitted at the Property except if: (1) the home is specifically listed as dog friendly, or (2) they are recognized as bona fide service animals that we are required by law to allow under the federal Americans with Disabilities Act (ADA). Emotional support animals are not permitted. You agree that a prohibition on animals is not a guarantee that an animal has not been inside the Property or that the Property is free of animal or pet allergens. Violation of the pet policy will result in a charge of up to $1,000 and removal from the property.
ARTICLE IV: STRUCTURES, VEHICLES, AND EQUIPMENT
Section 4.1 Unauthorized Structures
No tents or other structures may be erected on the property without express written permission from Elite.
Section 4.2 Grills and Fire Equipment
Charcoal grills and outdoor heaters are prohibited. Only propane grills provided by Elite may be used.
Propane Grill Safety (Where Provided): Adult supervision required at all times when grill is in use. Check propane connections before use and ensure grill is on stable, level surface away from structures, overhangs, and flammable materials. Never use grill indoors or in enclosed areas. Turn off propane tank when finished and allow grill to cool completely. Clean grill after use and report any gas leaks, damaged parts, or malfunctions immediately. Guests liable for all damages caused by improper grill use.
Fire Pit Safety (Where Provided): Adult supervision required at all times – never leave fires unattended. Use only seasoned firewood or manufactured logs. DO NOT BURN: trash, plastic, treated lumber, cardboard, paper, leaves. Fires must be completely extinguished with water – “if it’s too hot to touch, it’s too hot to leave.” No fire pit use during windy conditions or burn bans. Check local fire restrictions before use. Guests liable for all fire-related damages including structural repairs, landscaping, smoke damage, and emergency response costs.
Section 4.3 Parking Restrictions
No parking is allowed in garages at any Elite property. Each property has a designated number of off-street parking spaces as specified in your reservation. Elite is not responsible for guests who exceed the vehicle maximum for off-street parking – additional vehicles must find parking elsewhere at guest’s own risk of being towed or ticketed. Guests must comply with all local parking regulations and restrictions.
Section 4.4 Trailers, Boats, and Motor Vehicles
The storing or parking of trailers, boats, or any motorized vehicles/RVs are not permitted unless you have written permission from Elite Lake Rentals.
Section 4.5 Furniture and Electronics
Moving furniture, unmounting TVs, or unplugging electronics is not allowed. A fee of up to $1,000 will be charged to card on file if furniture needs to be moved back to where it was originally or for any reassembly or repair.
Section 4.6 Septic System Care and Restrictions
Most Elite properties use septic systems requiring special care. Violations can cause expensive system failures and property damage.
DO NOT FLUSH: Feminine products, diapers, any wipes (including “flushable”), cigarette butts, dental floss, cotton products, medications, or excessive toilet paper.
DO NOT PUT DOWN DRAINS: Grease, fats, oils, melted butter, food scraps, coffee grounds, harsh chemicals, paint, large amounts of hair, shrimp tails, crab legs, pasta, rice, potatoes, corn husks, banana peels, celery, onions, asparagus, eggshells, bones, or any food waste.
USAGE LIMITS: Maximum 3 laundry loads per day (spaced out). Take reasonable-length showers. Report slow drains, backups, or odors immediately.
VIOLATIONS: Guests liable for all septic costs due to negligence/rule violations, including pump-outs ($300-$800), repairs, system replacement (up to $30,000+), property damage, and lost rental income.
ARTICLE V: SAFETY AND SECURITY
Section 5.1 Security Camera Disclosure
Some properties may have exterior-facing security cameras for safety purposes. No interior cameras are present at any Elite property.
Section 5.2 Property Security
To prevent theft or damage, you agree to close and lock doors and windows when not present at the Property and upon check-out.
Section 5.3 Children’s Safety
Guests are responsible for supervising children at all times, particularly around amenities such as pools, docks, bunk beds, water features, fire pits, and recreational equipment.
ARTICLE VI: AMENITIES AND FACILITIES
Section 6.1 Use of Amenities at Own Risk
Use of all amenities is at your own risk. Elite is not responsible for injuries or accidents related to amenity use.

Section 6.2 Amenity Availability
The Property is provided as-is, and Elite is not responsible for the inoperability or unavailability of any amenities. Amenity availability cannot be guaranteed, and no refunds will be issued for temporary outages or maintenance issues.
Section 6.3 Maintenance Issues and Reporting Requirements
You agree to contact Elite immediately upon noticing any maintenance or housekeeping problem, or any potentially hazardous condition.
Reporting and Resolution Requirements:
Section 6.4 Mid-Stay Access
Elite may coordinate access for cleanings or essential maintenance with appropriate notice to guests. Elite may enter the Property at reasonable times with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that Elite reasonably deems an emergency.
ARTICLE VII: FINANCIAL TERMS
Section 7.1 Payment Terms and Fraud Prevention
If paying by credit card, you represent that you are the account holder or authorized user. Elite may request alternative payment forms if fraud is suspected and may share information with law enforcement if necessary.
Section 7.2 Damage and Liability
Renter is liable for any and all damage to the property and agrees to accept charges to the card on file should damage occur during occupancy. You authorize Elite to bill your credit card for:

ARTICLE VIII: CANCELLATION AND REFUND POLICIES
Section 8.1 Cancellation Policy
Rental payments are fully refundable (less 3.5% processing fee and Admin fee) for cancellations received 60 or more days before the first night of your reservation. No refunds will be granted for cancellations less than 60 days before arrival, no-shows, early departures, or cancelled stay extensions.
Section 8.2 Travel Insurance
Elite strongly recommends purchasing comprehensive travel insurance to protect against financial loss if you must cancel your reservation for a covered reason. Elite offers trip insurance through CSA/Generali for 6.95% of the total trip cost.
Section 8.3 Service Interruptions and Weather
Elite shall not be liable for failure to make the property available due to circumstances beyond its control, including adverse weather, natural disasters, mechanical failures, evacuation orders, or utility outages. No refunds will be provided for utility service interruptions, internet failures, cable/WiFi disruptions beyond Elite’s control, or weather-related activity limitations.
Section 8.4 Winter Services
Elite provides snow removal services during winter months and will clear snow as soon as safely possible. Snow removal may take up to 24 hours after a snow event for driveways to be plowed and sidewalks to be shoveled. No refunds will be provided for delays in snow removal due to weather conditions or safety concerns.
ARTICLE IX: CHECK-IN AND CHECK-OUT
Section 9.1 Check-In and Check-Out Times
Check-in begins at 4:00 PM and check-out is at 10:00 AM. Elite will message guests if the property is ready early and activate their unique door code for early entry at that time.
Section 9.2 Late Check-Out
Late check-out may be available by request for a fee. Since Elite does not hold dates without payment, late check-out cannot be guaranteed and requests will not be approved until the evening before your departure date. Failure to vacate by the designated checkout time (or approved late checkout time) authorizes Elite to charge a late departure fee up to one night’s rental and remove occupants and personal property.
Section 9.3 Checkout Requirements
Guests must complete the following checkout procedures:
Failure to follow checkout procedures may result in additional cleaning fees.
Section 9.4 Lost and Found
Elite Lake Rentals is not responsible for items left behind. Guests may call Elite to inquire about items left behind and Elite will check the property if possible. If items are found and guests request shipping, guests are responsible for all shipping costs.
Section 9.5 Keyless Entry Systems
All Elite Lake Rentals properties feature keyless entry systems. If you experience access issues, contact Elite immediately for remote assistance or new access codes. Elite is responsible for maintaining keyless entry system functionality, including battery replacement.
ARTICLE X: GUEST VERIFICATION AND SAFETY
Section 10.1 Guest Verification
Renter gives permission to SafelyStay, Inc., to verify identity and check criminal databases to confirm the reservation. Complete terms regarding guest verification can be found at www.safely.com/terms.
Section 10.2 Trust and Safety Coverage
The SafelyStay, Inc. Trust and Safety Fee includes up to $5,000 of accidental coverage for contents damage and up to $1,000,000 coverage for accidental property damage and bodily injury. All damage must be reported to Elite prior to departing the property for claims to be approved. You are responsible for intentional damage and authorize Elite to bill your credit card for all repairs and replacements needed due to intentional damage.
ARTICLE XI: EMERGENCY PROCEDURES
Section 11.1 Emergency Response
Elite provides a 24/7 guest service phone number for emergencies. Emergency issues (HVAC failure, plumbing problems, fire, injury, alarms) will be addressed immediately. Non-urgent concerns may be handled the next business day.
ARTICLE XII: LEGAL PROVISIONS
Section 12.1 Property Substitution
Elite reserves the right to substitute a comparable property if the original Property becomes unavailable due to ownership changes, removal from rental use, or extensive repairs. If comparable accommodations are unavailable, you may select other available properties or receive a complete refund.
Section 12.2 Chargeback Waiver
Guests agree not to initiate a credit card chargeback without first attempting resolution with Elite Lake Rentals.
Section 12.3 Legal Fees
Guests agree to pay all legal and collection costs resulting from contract violations or unpaid balances.
Section 12.4 Assignment
Elite may assign this Agreement or any of its rights, or delegate any duties, at any time without your consent.
ARTICLE XIII: DISPUTE RESOLUTION
Section 13.1 Choice of Law
This Agreement shall be governed by the laws of the State of Wisconsin, U.S.A., without regard to conflict-of-law provisions.
Section 13.2 Arbitration Agreement
Any controversy or claim arising out of or relating to this contract shall be settled by arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall take place in the county where the Property is located, or in Wisconsin if the dispute does not involve a specific property.
Section 13.3 Exceptions to Arbitration
Both parties retain the right to pursue claims in small claims court within the court’s jurisdiction, and suits to enjoin infringement or misuse of intellectual property rights.
Section 13.4 Class Action and Jury Trial Waiver
Any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. The parties waive any right to a jury trial.
ARTICLE XIV: LIMITATIONS AND DISCLAIMERS
Section 14.1 Acknowledgment of Risk
You acknowledge that the Property may have features and conditions unfamiliar to you, and that use of the Property and its amenities may carry inherent risks, including risk of bodily injury, illness, disability, or death. You voluntarily assume these risks and full responsibility for your choices. You acknowledge and agree that you and any other adult Occupants are solely responsible for closely supervising and protecting the health and safety of any minor children throughout the duration of your stay.
Wildlife and Natural Environment: Properties may be located in areas with natural wildlife including but not limited to bees, wasps, hornets, spiders, snakes, mice, bats, birds, deer, bears, or other animals. Neighboring pets (dogs, cats, etc.) may also wander onto the property and are beyond Elite’s control. Bee nests, wasp nests, spider webs, and other wildlife habitats may appear seasonally and are beyond Elite’s control. Guests assume all risks associated with wildlife encounters and neighboring animals and acknowledge that Elite cannot guarantee a wildlife-free environment or control neighboring pets. If wildlife or animals present an immediate safety threat, contact Elite immediately, but guests acknowledge that immediate removal may not always be possible due to environmental regulations, weather conditions, or specialist availability.
Section 14.2 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE AND OWNER EXPRESSLY DISCLAIM ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND AS TO THE ADEQUACY OF DIRECTIONS AND WARNINGS PROVIDED.
Section 14.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE, OWNER, AND THEIR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR DAMAGES FOR PERSONAL INJURY, ILLNESS, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE ARISING FROM YOUR STAY.
Section 14.4 Indemnification
You agree to hold harmless and indemnify Elite, Owner, and their affiliates from all claims for property damage, personal injury, illness, or monetary loss resulting from your actions or the actions of other Occupants during your stay.
ARTICLE XV: CONSEQUENCES OF BREACH
Section 15.1 Breach and Termination
Any failure to comply with the terms of this Agreement constitutes a breach and may result in forfeiture of your rights to rent the Property, including immediate removal without refund, with or without law enforcement assistance.
Specific Grounds for Immediate Termination: The following violations constitute material breach and grounds for immediate termination without refund:
Section 15.2 Immediate Removal
Elite may terminate this Agreement for breach, and upon notification of such termination, you agree to leave the Property immediately.
ARTICLE XVI: MISCELLANEOUS PROVISIONS
Section 16.1 Property-Specific Terms
Certain jurisdictions and specific properties may require additional terms and conditions. Any Property-Specific Terms will be communicated during the reservation process and will control over conflicting provisions in this Agreement.
Section 16.2 Third-Party Channel Terms
If booking through a third-party marketing channel, your booking may be subject to that channel’s terms and conditions, which will control over conflicting provisions in this Agreement.
Section 16.3 Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to the subject matter herein.
Section 16.4 Severability
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
THIS PROPERTY IS MANAGED BY ELITE LAKE RENTALS LLC
A BREACH OF ANY OF THE ABOVE TERMS MAY RESULT IN A FORFEITURE OF YOUR RIGHTS REGARDING THIS RENTAL PROPERTY, INCLUDING EVICTION FROM THE PREMISES WITHOUT REFUND.
By booking with Elite Lake Rentals through any method (online, phone, or third party), you acknowledge that you have read, understood, and expressly agree to be bound by all terms and conditions set forth in this Agreement. These terms are available on the EliteLakeRentals.com website as well as all third-party booking channels prior to booking and must be accepted in order to process payment. Your booking confirmation serves as your electronic signature and acceptance of this Agreement, and you waive any claim that you did not receive or review these terms.
